Terms of Service
These Terms govern your use of TailWhales. By creating an account, subscribing, or using the service, you agree to them.

1. What TailWhales is
TailWhales is an informational analytics product. It displays publicly available information about prediction-market activity — including the on-chain and public-API activity of large Polymarket traders — together with derived metrics such as historical ROI and realized profit. TailWhales is non-custodial: it never holds your funds, never has access to your wallets or exchange accounts, and never places, executes, or facilitates any trade or bet on your behalf. Any decision to place a bet is yours alone and is carried out by you, directly, on a third-party platform.
TailWhales is not financial, investment, legal, tax, or gambling advice, is not a broker-dealer, investment adviser, commodity trading advisor, or futures commission merchant, and is not registered with the SEC, CFTC, FINRA, or any equivalent regulator. 2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) and legally permitted to use the service where you live. You are solely responsible for complying with the laws of your jurisdiction, including any restrictions on accessing prediction-market or event-contract platforms. We may restrict access from certain jurisdictions and may decline or terminate service at our discretion.
3. Accounts
Authentication is provided by Clerk. You are responsible for the activity under your account and for keeping your credentials secure. Notify us promptly of any unauthorized use.
4. Subscriptions, billing & cancellation
- Paid plans are billed in advance through Stripe on a recurring monthly basis at the price shown at checkout.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period until cancelled. By subscribing you authorize TailWhales (via Stripe) to charge your payment method for each renewal.
- Cancel anytime. You can cancel from the billing portal in your account; cancellation stops future renewals and takes effect at the end of the current paid period. We do not require you to contact support or jump through extra steps to cancel.
- Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods. If you believe you were charged in error, email legal@tailwhales.com within 14 days and we will review it in good faith.
- Price & plan changes will be communicated before they take effect; continued use after a change constitutes acceptance.
- Taxes may be added where applicable.
5. Acceptable use
You agree not to:
- use the service for any unlawful purpose or in any jurisdiction where it is prohibited;
- scrape, resell, or redistribute TailWhales data or build a competing product from it;
- circumvent access controls, rate limits, geo-restrictions, or paywalls;
- interfere with, overload, or attempt to compromise the service or its infrastructure;
- misrepresent TailWhales as financial advice or as affiliated with any market venue or regulator.
6. Third-party platforms & data
TailWhales references and analyzes activity on third-party platforms (including Polymarket) using publicly available on-chain data and public APIs. We are not affiliated with, sponsored by, or endorsed by Polymarket or any other venue, and we are not responsible for those platforms, their availability, their terms, or the outcome of any market. Trademarks belong to their respective owners and are used nominatively to describe the data we present.
7. No warranty
The service and all data, metrics, and signals are provided “as is” and “as available,” without warranties of any kind, express or implied, including accuracy, completeness, timeliness, merchantability, or fitness for a particular purpose. Markets are volatile and data can be delayed, incomplete, or wrong. Past performance is not indicative of future results.
8. Limitation of liability
To the maximum extent permitted by law, TailWhales and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, money, or bets/trades, arising out of or related to your use of the service. Our total aggregate liability for any claim will not exceed the greater of (a) the amount you paid us in the 3 months before the claim or (b) US$50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless TailWhales and its operators from any claim arising out of your use of the service, your bets or trades, or your breach of these Terms or any law.
10. Termination
You may stop using the service at any time. We may suspend or terminate access for breach of these Terms or to comply with law. Sections that by their nature should survive (disclaimers, liability limits, indemnification, governing law) survive termination.
11. Governing law & disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Any dispute will be resolved by binding individual arbitration, and you and TailWhales waive any right to a jury trial or to participate in a class action, except where such waiver is prohibited by law. You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@tailwhales.com.
12. Changes
We may update these Terms. Material changes will be reflected by the “Last updated” date and, where appropriate, by notice in the product. Continued use after changes take effect means you accept them.
